New York is unlikely to have an extended producer responsibility (EPR) law this year.
The State Assembly adjourned June 17, 2025, before an EPR bill could reach the floor. Unless a special session takes place in the fall, an EPR measure will not be passed until at least 2026, according to John Richard, director of government relations for the Flexible Packaging Association (FPA).
“FPA and its coalition allies managed to be the last lobbyists standing in the Assembly lobby, working until the very end of the session to ensure our success,” Richard says in an email to FPA members.
Richard says the New York proposal was a “particularly problematic” EPR bill, and FPA will fight for a better-designed bill next year.
