New York Shelves EPR Plan for 2026

Legislators in New York did not advance extended producer responsibility (EPR) legislation before the 2026 legislative session ended last week.

Until the early morning hours of June 5, A1749 and S1464 were still active but failed to advance, says Andy Hackman, a lobbyist for the Flexible Packaging Association (FPA) and a principal lobbyist at the firm Serlin Haley.

Opponents of the bills had argued in part that the bills would have increased costs for consumers, Hackman says.

Unlike EPR laws passed elsewhere, the New York proposals would have made producers of packaging responsible for landfilling as well as recycling and would have banned advanced recycling.

Legislation is likely to be re-introduced in 2027, Hackman says.
